1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Tipsy Berry mobile application ("App") provided by Tipsy Berry ("we", "our", "us"). By downloading or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

The App contains cocktail recipes and alcohol by volume (ABV) information and is intended for adults of legal drinking age. You must be at least 21 years old in the United States, or of legal drinking age in your jurisdiction, to use the App. By using the App you represent and warrant that you meet this requirement. We reserve the right to terminate access if we have reason to believe this condition is not met.

3. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control, solely for your personal, non-commercial purposes. You may not sublicence, resell, or transfer the App or your access to it.

4. User Conduct

You agree not to:

  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App.
  • Scrape, copy, or reproduce any recipe content, illustrations, or other app content for redistribution.
  • Use the App for any unlawful purpose or in violation of any applicable law or regulation.
  • Circumvent or disable any technical measures we use to protect the App.
  • Misrepresent your identity or affiliation when contacting us.

5. Drink Responsibly

The recipes, ingredient lists, and ABV information in this App are provided for educational and entertainment purposes only. They are not professional bartending advice, health guidance, or an encouragement to drink alcohol to excess.

Always drink responsibly. Never drink and drive. Be aware of how alcohol interacts with medications and health conditions. Follow the laws of your jurisdiction regarding alcohol consumption and service. We are not liable for any consequences arising from your consumption of alcohol.

6. Intellectual Property

All content in the App — including but not limited to the 50 cocktail and mocktail recipes, step-by-step methods, history blurbs, Berry's pro-tips, hero illustrations, the Berry strawberry mascot character (including likeness, name, and design), Mixology 101 knowledge-card illustrations, the app name "Tipsy Berry", and all associated brand assets — is the exclusive intellectual property of Tipsy Berry or its licensors and is protected by copyright, trademark, and other applicable laws. Nothing in these Terms transfers any intellectual property rights to you.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The App will be uninterrupted, error-free, or free of viruses or harmful components.
  • The results obtained from using the App will be accurate or reliable.
  • Any defects will be corrected.

Allergen notice: Cocktail recipes include ingredients that may cause allergic reactions (e.g. nuts, dairy, eggs, sulphites). You are solely responsible for checking ingredients against any allergies or dietary requirements you or your guests may have. We are not liable for any allergic reaction or adverse health outcome.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Tipsy Berry and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the App.
  • Any content obtained from the App.
  • Unauthorised access to or alteration of your data.

In no event will our aggregate liability to you exceed the amount you paid (if any) for the App in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tipsy Berry and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any applicable law.

10. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination the licence granted under Section 3 ends immediately. Sections 6, 7, 8, 9, and 11 survive termination.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the operator is established, without regard to its conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for any dispute arising under these Terms.

12. Changes to Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If we make material changes we will provide a more prominent notice.
